  • Contract for the Provision of Quarantine Boarding Services for a Dog / Cat in a Transitional Facility

    This contract sets out in full the terms and conditions upon which Canterbury Quarantine Services 2011 Limited may agree to board pet dogs and cats for the owner in a “Transitional Facility.”

    New Zealand Law requires that before you can import your pet into New Zealand, they must first meet stringent identification checks, disease checks and undergo a dedicated programme of vaccinations prior to their arrival. Those checks and vaccinations must be thoroughly documented in your pets’ country of origin. If the New Zealand authorities accept your pet into New Zealand it must then be quarantined in an approved “Transitional Facility” from which it cannot be released until permitted by the New Zealand authorities. Canterbury Quarantine Services 2011 Limited operates as an approved Transitional Facility for that purpose.

    Canterbury Quarantine Services 2011 Limited can receive your pet upon its arrival in New Zealand only if the importation of the pet satisfies in all other respects the requirements of the Import Health Standards set by the New Zealand Ministry for Primary Industries. Canterbury Quarantine Services 2011 Limited has no control or supervision over compliance with those standards. Officials of the New Zealand Ministry for Primary Industries decide whether your pet will be permitted to enter New Zealand. Your pet will not be permitted entry unless you the owner have ensured that your pet, and all documentation concerning it, comply with all import requirements.

    On its arrival in New Zealand your pet must be met at the point of arrival by representatives both of the New Zealand authorities and of Canterbury Quarantine Services 2011 Limited. Your pet will not be permitted to enter New Zealand if it cannot be accommodated in an approved Transitional Facility.

    Canterbury Quarantine Services 2011 Limited must comply with stringent security and quarantine requirements.

    Those requirements are intended to ensure that:

    No diseased animal enters New Zealand

    No disease is spread among animals in the quarantine facility or outside of the quarantine facility.

    If an animal contracts or is carrying a disease or virus which the facility exists to constrain, then that disease or virus will spread no further.

    New Zealand Law requires that if during the period of quarantine an animal contract’s such a disease or illness, then the animal will be treated, exported, destroyed or detained further in quarantine.

    New Zealand law dictates the number of pets which Canterbury Quarantine Services 2011 Limited may board at any one time. It must have adequate notice of the arrival date of every pet arriving at Christchurch which will be boarded in its facility. If there is no accommodation available for the animal upon its arrival then it will be returned by the New Zealand authorities to its country of origin at the owner’s expense. For this reason it is crucial that Canterbury Quarantine Services 2011 Limited have at least 30 days notice of any anticipated change in the arrival date of the animal at Christchurch Airport. Even if 30 days notice is given, Canterbury Quarantine Services 2011 Limited cannot guarantee that it will be able to receive your pet, due to other booking constraints. If it cannot, and you the owner permit your pet to be sent to New Zealand, then the New Zealand authorities may return it to its country of origin at the owner’s expense.

    The Parties agree as follows

    Canterbury Quarantine Services 2011 Limited agrees to provide boarding facilities for your pet in a Transitional Facility for dogs and cats, operated in accordance with applicable law and regulation, on the terms and conditions set out herein.

    This contract comes into force when Canterbury Quarantine Services 2011 Limited confirms to you the owner that it will accept your pet or pets.

    The owner will pay a deposit of $NZ500.00 (inclusive of GST) to Canterbury Quarantine Services 2011 Limited within seven days of confirmation of this contract by Canterbury Quarantine Services 2011 Limited pursuant to paragraph 2 above. That deposit will not be repaid to the owner if this contract subsequently comes to an end.

    The owner will pay Canterbury Quarantine Services 2011 Limited in full prior to the pets departure from quarantine as per the attached price list schedule A or B.

    The deposit of $NZ500.00 per pet will be deducted from the sum owing in fees to Canterbury Quarantine Services 2011 Limited pursuant to clause 4 above.

    The owner will pay all fees payable to the New Zealand authorities, including the Ministry for Primary Industries, in full, either prior to or at the time of release of your pet/s from the quarantine facility. The owner acknowledges that the pet cannot be released until all such fees are paid.

    The owner acknowledges that Canterbury Quarantine Services 2011 Limited must release the pet/s from quarantine when requested to do so by the New Zealand authorities. The owner will pay all fees owing to Canterbury Quarantine Services 2011 Limited in full prior to or on release from quarantine of the pet.

    The owner further acknowledges that Canterbury Quarantine Services 2011 Limited reserves the right, if circumstances dictate, to put down a pet/s if the above conditions are not met.

    This contract is conditional upon your pet/s arriving on the stated date as per your booking confirmation, allowing for reasonable variations due to airline delays of up to plus 24 hours. If it does not do so this contract may be brought to an end at the option of Canterbury Quarantine Services 2011 Limited.

    The owner undertakes to inform Canterbury Quarantine Services 2011 Limited of any change to the arrival date or time of their pet/s at least 45 days prior to the changed date or time of arrival. If there is such a change Canterbury Quarantine Services 2011 Limited may not be able to accept the pet/s. Canterbury Quarantine Services 2011 Limited will inform the owner if this is so as soon as possible after receipt of notification of a change to the arrival date or time. This contract will then be at an end and the deposit of $NZ500.00 per pet will remain the property of Canterbury Quarantine Services 2011 Limited.

    The owner agrees that once a booking confirmation has been issued by Canterbury Quarantine Services 2011 Limited any change of dates resulting in the issue of another booking confirmation will be charged as a re-booking fee of $NZ200.00 in addition to all other fees.

    The owner or any signatory to this contract on behalf of or Agent for the owner acknowledges and accepts that should less than 45 days notice of cancellation be notified to Canterbury Quarantine Services 2011 Ltd, irrespective of the reason, that they are liable for the full quarantine fee applicable and as set out in the attached schedule of fees (Schedule A or B).

    Note: This liability and acceptance of fees payable in the event of inadequate notice of cancellation is necessary to recover the costs of quarantine accommodation space already booked for your pet which due to the nature of the business cannot be readily assigned within that period of time.

    The owner acknowledges that if a pet/s arrives without prior arrangement at a date and time not previously agreed to by Canterbury Quarantine Services 2011 Limited then it may be returned by the New Zealand authorities to its country of origin at the expense of the owner. The deposit will remain the property of Canterbury Quarantine Services 2011 Limited.

    Canterbury Quarantine Services 2011 Limited will exercise reasonable skill and care in providing for the health and well-being of all pets in its care, subject to New Zealand law and regulation; however, the owner agrees that Canterbury Quarantine Services 2011 Limited cannot be held liable for any harm caused to the pet/s, or for any loss caused directly or indirectly to the owner, by Canterbury Quarantine Services 2011 Limited, its agents or employees.

    Owners agree to pay any costs for damages caused by their pet(s) including furnishings and structural damage. Canterbury Quarantine Services 2011 Ltd will provide quotes for damage from an independent builder and you agree to cover the costs for labour and materials to repair any damage made by your pet.
